If you find you have to deal with Immigration and Custom Enforcement (I.C.E.), it is important to know and exercise your rights. DO NOT OPEN THE DOOR. Ask the I.C.E. agent if they have an arrest warrant signed by a judge and to slide it under the door. You don't have to answer their questions under any circumstances. Check the name, date, and address - including spelling. If there are any errors, tell them it is incorrect and do not open the door. If you are in a public space, ask: Am I being arrested or detained? If yes, exercise your right to remain silent and ask to speak to a lawyer. If no, ask if you can leave and then leave calmly. REMAIN SILENT You have the right to remain silent. If you encounter an I.C.E. agent, say the following: "I exercise my right to remain silent under the 5th amendment of the US constitution." PROTECT YOUR INFORMATION Do not give out personal information or answer any questions about your status. Do not hand over your ID or papers to I.C.E. agents. Do not sign any form of documents (paper or digital) that the I.C.E. agents give you without speaking with an attorney. Law Enforcement Encounters: Know Your Rights IN YOUR WORKPLACE • If you are stopped, do not run and do not provide false information. • If you are asked questions, say "I want to remain silent and speak with a lawyer." Do not answer questions about your immigration status or otherwise reveal your immigration status. IN YOUR HOME If ICE agents come to your home, do not open the door. • Ask to see a judicial warrant. Ask ICE to slip it under the door or window. • If they do not have a warrant, do not answer their questions. Say "I do not consent to your entry." If they have a warrant, check that it is signed by a judge. If it is not, do not consent to entry or answer questions. If they have a warrant signed by a judge, ICE agents can only search the place named in the warrant or detain the person named in the warrant. If there is a person named in the judicial warrant, send only that person out of the home to be detained. Do not answer questions about persons not named in the warrant. Do not sign anything that ICE gives you, without first talking to an attorney.
